1. Acceptance of Terms

By accessing or using the website located at www.wstacademy.mom, enrolling in any educational program, or otherwise engaging with services provided by WST Academy, a division of Wst Education Corp., you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions set forth herein, you must not access the website or use any of our services.

These Terms of Service constitute a legally binding agreement between you, whether personally or on behalf of an entity you represent, and Wst Education Corp. regarding your access to and use of our educational platform, digital resources, training programs, and related services. We reserve the right to modify these terms at any time, with changes becoming effective upon posting to this page.

2. Definitions and Scope

Throughout these Terms of Service, the following definitions apply to provide clarity regarding the rights and obligations of all parties involved in the use of WST Academy services.

WST Academy refers to the educational division of Wst Education Corp., the entity providing computer systems design training, professional development programs, and related educational services as described on our website and in our program documentation.

Services encompasses all educational offerings provided by WST Academy, including but not limited to online courses, in-person training, hybrid programs, certification examinations, learning management platform access, digital course materials, mentorship sessions, workshops, webinars, and any other educational resources made available through our platform.

User or you refers to any individual or entity that accesses our website, creates an account, enrolls in a program, participates in training, or otherwise interacts with our services. A user may be a student, instructor, administrator, or visitor browsing publicly available content.

Content includes all text, images, videos, audio recordings, software code, course materials, assessments, presentations, documentation, designs, and any other intellectual property presented or distributed through our platform.

3. Eligibility and Registration

Use of WST Academy services is restricted to individuals and entities that meet our eligibility requirements. By registering for an account or enrolling in a program, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

You must be at least eighteen years of age or the age of majority in your jurisdiction, whichever is higher, to create an account or enroll in our programs. Some advanced programs may have additional prerequisites, including prior educational attainment, professional experience, or technical certifications, which will be clearly stated in program descriptions.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify WST Academy immediately of any unauthorized use of your account or any other breach of security. WST Academy shall not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. Account Responsibilities

Each user is limited to one personal account, and accounts may not be shared, transferred, or used by multiple individuals unless explicitly authorized in writing by WST Academy. You agree to provide accurate and complete information during the registration process and to update such information promptly whenever it changes.

You are solely responsible for all activity conducted through your account, whether authorized by you or not. This includes course enrollment decisions, assessment submissions, communication with instructors and other students, and compliance with program policies. WST Academy reserves the right to suspend or terminate accounts that violate these terms or that are used to engage in fraudulent, abusive, or otherwise harmful conduct.

You agree not to impersonate any person or entity, falsely claim an affiliation with any person or entity, or access accounts of other users without permission. You further agree not to use our services for any purpose that is unlawful or prohibited by these Terms of Service.

5. Educational Services and Program Enrollment

WST Academy offers a range of educational programs specializing in computer systems design, integration engineering, enterprise architecture, and related technical disciplines. Program descriptions, schedules, prerequisites, and pricing are provided on our website and in program-specific documentation.

Enrollment in a program is confirmed upon receipt of completed registration materials and payment of applicable fees, unless otherwise specified for employer-sponsored or scholarship-funded enrollments. WST Academy reserves the right to cancel or reschedule programs due to insufficient enrollment, instructor unavailability, or circumstances beyond our reasonable control. In the event of cancellation by WST Academy, registered students will receive a full refund of tuition fees paid or the option to transfer enrollment to a future session.

Program content, instructors, schedules, and formats are subject to change. WST Academy will make reasonable efforts to notify enrolled students of significant changes, but such changes shall not give rise to refund rights except as expressly provided in our refund policy.

6. Fees and Payment Terms

All fees for WST Academy programs and services are displayed on our website at the time of enrollment and are denominated in United States Dollars unless otherwise indicated. You are responsible for payment of all applicable fees, including any taxes, duties, or governmental charges imposed on the services provided.

Payment is due at the time of enrollment unless an installment plan or employer billing arrangement has been agreed upon in writing. We accept payment through major credit cards, debit cards, electronic funds transfers, and other methods as displayed during the checkout process. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full amount due.

Late payments may result in suspension of access to course materials and platform features until the outstanding balance is resolved. Accounts with delinquent balances exceeding sixty days may be referred to collections, and you agree to reimburse WST Academy for all reasonable costs incurred in collecting past-due amounts, including legal fees.

7. Refund and Cancellation Policy

WST Academy provides the following refund policy to ensure fairness and transparency in our enrollment process. Refund eligibility and amounts depend on the timing of your cancellation relative to the program start date.

For cancellations made at least fourteen calendar days before the program start date, you are entitled to a full refund of tuition paid, minus a non-refundable administrative processing fee of seventy-five dollars. For cancellations made between seven and thirteen calendar days before the program start date, you are entitled to a fifty percent refund of tuition paid. No refunds are available for cancellations made fewer than seven calendar days before the program start date or after the program has commenced.

To request a cancellation and refund, you must submit a written request to service@wstacademy.mom including your full name, the program title, and the reason for cancellation. Refunds will be processed within thirty business days of approval to the original payment method used for enrollment.

8. Intellectual Property Rights

All content, materials, and resources provided through WST Academy services, including but not limited to course curricula, lecture recordings, presentation slides, written materials, software tools, assessments, exercises, digital assets, and platform design elements, are the exclusive intellectual property of Wst Education Corp. or its licensors and are protected by copyright, trademark, and other intellectual property laws of Canada and applicable international treaties.

Your enrollment in a program grants you a limited, non-exclusive, non-transferable, revocable license to access and use the educational materials solely for your personal, non-commercial learning purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any content from our services except as explicitly permitted by these terms or with prior written consent from WST Academy.

The WST Academy name, logo, and all related marks, slogans, and designs are trademarks of Wst Education Corp. You may not use these marks without our prior written permission. All other names, logos, and marks appearing on our platform are the property of their respective owners.

9. User-Generated Content

Certain features of our platform, such as discussion forums, project submission areas, peer review interfaces, and collaborative workspaces, may allow you to post, upload, or share content including commentary, questions, code samples, project work, and other materials. You retain ownership of any intellectual property rights you hold in such user-generated content.

By posting or uploading content to our platform, you grant WST Academy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and display such content in connection with operating, providing, and improving our educational services. This license continues until you delete the content from our platform, provided that content shared with other users may persist in archived records.

You represent and warrant that your user-generated content does not infringe the intellectual property rights, privacy rights, or any other legal rights of any third party, and that it complies with all applicable laws and our acceptable use standards. WST Academy reserves the right, but has no obligation, to monitor, review, and remove user-generated content at its sole discretion.

10. Acceptable Use Policy

WST Academy is committed to maintaining a respectful, professional, and productive learning environment for all users. Your use of our services must comply with this Acceptable Use Policy, and any violation may result in suspension or termination of your account and access to services.

You agree not to use our platform or services to upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another privacy, hateful, or racially, ethnically, or otherwise objectionable. You further agree not to engage in conduct that disrupts or interferes with the learning experience of other students, including spamming, trolling, or flooding discussion forums.

Prohibited activities also include attempting to gain unauthorized access to our systems or other user accounts, probing or testing the vulnerability of our platform, circumventing any security or authentication measures, introducing malicious code or malware, and using our services for any commercial purpose not expressly authorized by WST Academy. You may not use any data mining, robots, scraping, or similar data gathering or extraction methods in connection with our platform.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with your use of WST Academy services are governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. You acknowledge that you have read and understood the Privacy Policy and agree to the data practices described therein.

By using our services, you consent to the collection and processing of your personal information as described in the Privacy Policy. If you are located outside of Canada, you consent to the transfer of your personal data to Canada and other jurisdictions where we or our service providers operate for processing in accordance with the Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Wst Education Corp., its affiliates, officers, directors, employees, agents, instructors, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, our services.

WST Academy provides educational services on an as is and as available basis. While we strive for accuracy and quality, we do not warrant that our content is error-free, that our platform will operate without interruption, or that any particular learning outcome or career result will be achieved. Any reliance you place on information provided through our services is strictly at your own risk.

In no event shall the aggregate liability of Wst Education Corp. for all claims relating to your use of our services exceed the total amount of fees paid by you to WST Academy during the twelve-month period preceding the event giving rise to the claim, or one hundred United States dollars if no fees were paid. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Wst Education Corp., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable legal fees, arising out of or relating to your violation of these Terms of Service or your use of the website and services.

This indemnification obligation includes claims arising from your user-generated content, your use of any content or services other than as expressly authorized in these terms, your violation of any third-party right including intellectual property or privacy rights, or any claim that your content caused damage to a third party. WST Academy reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

14. Termination and Suspension

WST Academy reserves the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice, effective immediately. Grounds for termination include, but are not limited to, violation of these Terms of Service, conduct that we determine to be harmful to other users or our business interests, or as required by applicable law.

Upon termination, your right to access and use our services will immediately cease. All provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. If your account is terminated for cause, you will not be entitled to any refund of fees paid, and any outstanding balances owed to WST Academy shall become immediately due.

You may terminate your account at any time by contacting us at service@wstacademy.mom. Termination of your account does not automatically entitle you to a refund of fees paid, which shall be determined in accordance with the refund policy applicable at the time of your enrollment.

15. Disclaimer of Warranties

Your use of WST Academy services is at your sole risk. Our services, including all content, materials, and platform features, are provided on an as is and as available basis without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

WST Academy does not warrant that the services will meet your specific requirements, that the services will be uninterrupted, timely, secure, or error-free, that the results that may be obtained from the use of the services will be accurate or reliable, or that any errors in the services will be corrected. No oral or written information or advice given by WST Academy or its authorized representatives shall create any warranty not expressly stated in these terms.

16. Governing Law and Dispute Resolution

These Terms of Service and any disputes arising out of or related to your use of WST Academy services shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these terms, including the validity, interpretation, breach, or termination thereof, shall first be attempted to be resolved through good-faith negotiation between the parties. If resolution is not achieved within thirty days of the initial written notice of the dispute, either party may pursue resolution through binding arbitration administered in Toronto, Ontario, in accordance with the Arbitration Act of Ontario.

Notwithstanding the foregoing, WST Academy retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights. You agree to submit to the personal jurisdiction of the courts located in Toronto, Ontario, for the purpose of litigating any such claims.

17. Force Majeure

WST Academy shall not be liable or responsible for any failure to perform or delay in performance of any obligation under these Terms of Service that is caused by events outside our reasonable control, including but not limited to acts of God, flood, fire, earthquake, epidemic, pandemic, war, invasion, hostilities, terrorist acts, civil unrest, government order or regulation, national or regional emergency, labor strikes, or failures of the internet, telecommunications networks, or third-party hosting infrastructure.

In the event of a force majeure occurrence, WST Academy will make reasonable efforts to resume services as soon as practicable and to provide alternative arrangements where feasible. If a program session is interrupted by a force majeure event, WST Academy may reschedule sessions, transition to online delivery where appropriate, or offer pro-rated credits toward future programs at its discretion.

18. General Provisions

These Terms of Service, together with our Privacy Policy and any program-specific enrollment agreements, constitute the entire agreement between you and Wst Education Corp. regarding your use of WST Academy services and supersede all prior agreements, understandings, and representations, whether written or oral.

If any provision of these terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to reflect the parties original intent as closely as possible while remaining valid, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

You may not assign or transfer any of your rights or obligations under these terms without our prior written consent. WST Academy may assign or transfer these terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets. These terms do not create any third-party beneficiary rights.

Notices to you may be sent to the email address associated with your account or posted on our website. You are responsible for maintaining current contact information in your account. Notice shall be deemed given twenty-four hours after an email is sent, or three business days after the date of mailing if sent by certified mail.
